Agbakoba sues AGF, NJC asks court to declare suspension of CJN unconstitutional

 

Dr. Olisa Agbakoba SAN has asked the Federal High Court, Lagos Division to declare as unconstitutional the procedure adopted by the President of Nigeria, to suspend the Chief Justice of Nigeria, Honourable Justice Walter Samuel Nkanu Onnoghnen.

The grounds of the claim is that Judicial Officers including the Chief Justice of Nigeria enjoy Judicial Immunity and have constitutionally guaranteed tenure of office that can only be interfered with by the administrative action of the National Judicial Council or the President acting on an address supported by two thirds majority of the Senate.

According to Agbakoba, in the suspension of the Chief Justice of Nigeria, Justice Walter Samuel Nkanu Onnoghnen, the President of Nigeria did not adopt either of the procedures.

No date has been fixed for hearing.
